Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of FreshBooked ("FreshBooked," "we," "us," or "our"), including our website, platform administration tools, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

FreshBooked provides online scheduling and booking software for barber shops, salons, and similar businesses. Platform administrators may create and manage business accounts, configure domains, and oversee platform settings. Each business may offer its own public booking experience to its customers.

3. Eligibility and accounts

Platform access is limited to authorized administrators whose email addresses have been approved by FreshBooked. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, fraudulent, or abusive purposes
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer or copy the Service except as permitted by law
  • Use the Service to send spam or unsolicited communications

5. Business accounts and customer data

When you create or manage business accounts on the platform, you are responsible for ensuring that each business complies with applicable laws, including those relating to customer bookings, payments, cancellations, and privacy. FreshBooked processes data on behalf of businesses as described in our Privacy Policy.

6. Payments

Where payment processing is enabled, transactions may be handled through third-party providers such as Square. Payment terms, fees, refunds, and chargebacks may be subject to the policies of those providers and of the individual business. FreshBooked may collect a platform fee on certain transactions as disclosed in the platform administration interface.

7. Intellectual property

FreshBooked and its licensors retain all rights in the Service, including software, branding, and documentation. You receive a limited, non-exclusive, non-transferable right to access and use the Service for its intended purpose while your access remains authorized.

8. Third-party services

The Service may integrate with or link to third-party services, including email delivery, hosting, domain, analytics, and payment providers. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESHBOOKED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESHBOOKED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.

11. Suspension and termination

We may suspend or terminate access to the Service at any time if we reasonably believe you have violated these Terms or if continued access poses a security or legal risk. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitations of liability.

12. Changes

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, except where mandatory local law applies.
